Terms and Conditions
Last updated: September 17th, 2026.
These Terms and Conditions ("Terms") govern your use of www.fibonacciattire.com (the "Website") and any purchase you make through it. By placing an Order, you automatically accept these Terms in full.
1. Placing an Order
By placing an Order through our Website, you are making an offer to purchase Products. All Orders are subject to acceptance by us — we'll confirm your Order by email once accepted.
Payment must be made at the time of placing your Order. We accept [payment methods, e.g. Visa, Mastercard, Klarna, MobilePay].
You represent and warrant that you have the legal right to use any payment method(s) used in connection with any Order.
We reserve the right to cancel any Order if:
- Your payment information is incorrect or cannot be verified
- The Order appears to be linked to fraud or other illegal activity
- The item ordered is out of stock (in which case we will notify you and issue a full refund)
2. Pricing and Payment
All Products are subject to availability. We reserve the right to discontinue any Product at any time.
Prices for our Products are subject to change without notice. We shall not be liable to you or any third party for any modification, price change, or discontinuation of Products.
All Product descriptions and pricing are subject to change at any time without notice, at our sole discretion.
We reserve the right to refuse any Order you place with us, and may, at our sole discretion, limit or cancel quantities purchased per person, per household, or per Order.
3. Shipping and Returns
Shipping costs for Denmark, the EU, and international destinations are calculated at checkout.
We are not responsible for delivery delays caused by circumstances beyond our reasonable control.
Risk of loss and title for Products purchased from our Website pass to you upon our delivery to the carrier.
For full details on returns, see our [Return Policy].
4. VAT and Customs
US orders: From August 29, 2025, all orders to the United States are sent Delivered Duty Paid (DDP). Taxes, duties, and tariffs are included in the purchase price, resulting in a streamlined customs process and no additional fees on delivery. Pricing reflects USD retail pricing.
EU orders: Under EU One Stop Shop (OSS) rules, the VAT applied is based on your country's tax rate, so prices may vary by location. VAT is shown at checkout. Pricing reflects EUR retail pricing.
UK orders: Orders to the United Kingdom include VAT and are sent Delivered Duty Paid (DDP). Taxes, duties, and tariffs are included in the purchase price, resulting in a streamlined customs process and no additional fees on delivery. Pricing reflects GBP retail pricing.
Australian orders: Orders exceeding AUD 1,000 in total value may be subject to additional import duties, GST, and customs charges. To avoid this, consider splitting your Order into smaller shipments. Total order value is calculated before any promotional codes or discounts are applied at checkout.
All other non-EU orders (excluding the UK and US) are tax-free.
Prices at checkout are shown without VAT by default; if your IP address is not located correctly, VAT will be deducted once your delivery address is entered.
Local customs or import taxes may be charged at the destination; these are the responsibility of the customer.
We comply with all applicable international import/export laws. If you refuse a shipment, you are responsible for the original shipping charges and any duties, taxes, and/or customs charges incurred on both the original and return shipments, as well as the cost of returning the package. This amount will be deducted from your merchandise refund.
Your invoice includes the information required under applicable EU trade agreements and is included with your parcel. More information on these agreements is available on the European Commission website.
5. Right to Withdraw
If you are a consumer residing in the EU, you have the right to withdraw from your purchase within 14 days, without giving any reason, under the Danish Consumer Contracts Act (Forbrugeraftaleloven).
The withdrawal period expires 14 days after the day you, or a third party designated by you, receive the goods.
To exercise your right of withdrawal, you must notify us before the withdrawal period expires, either by:
- Completing and returning the physical withdrawal form included with your order, or
- Sending a clear written statement to Fibonacci at [contact email]
You must return the items no later than 14 days after notifying us of your withdrawal. Return shipping costs are at your expense. Items must be returned in their original condition — unworn, unwashed, undamaged, with tags attached, and in their original packaging.
We will issue a full refund of the purchase price, including any original standard delivery costs, within 14 days of receiving your notice of withdrawal, provided we have received the returned items or proof of return shipment. Refunds are issued to the same payment method used for your original transaction.
We may reduce your refund if the value of the goods has diminished due to handling beyond what is necessary to establish their nature and function.
6. Claims (Statutory Right to Claim)
Separately from, and in addition to, the 14-day withdrawal right above, Danish law gives you a two-year right to claim for defects present at the time of delivery (Købeloven). This right cannot be waived or shortened by these Terms.
To report a faulty item, contact Fibonacci with photo evidence of the defect and your order number.
7. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting.
By continuing to use the Website after revised Terms are posted, you accept and agree to the changes.
8. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.
9. Complaints
If you're unhappy with how a complaint has been resolved, you can bring it to:
Center for Klageløsning (Danish Center for Complaint Resolution) Nævnenes Hus, Toldboden 2, 8800 Viborg naevneneshus.dk
If you live in another EU country, you can also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr
10. Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be struck, and the remaining provisions shall continue in full force and effect.
11. Entire Agreement
These Terms, together with our [Privacy Policy] and [Return Policy], constitute the entire agreement between you and Fibonacci regarding your use of the Website.
